This registration is to establish a Register of Contractors and Suppliers for Indah Water Works tenders and procurement of goods and services. Only registered Contractor/Suppliers will be listed in the tender invitation list for tender in any Indah Water Projects.

The registration form is provided free of charge and can be obtained from all Indah Water offices. There is no registration fees imposed for normal registration.

A. Contractors

Contractors can be registered under one or more Registration Categories in accordance to the type of work and in accordance with the category of the work contracts.

For all construction works involving Capital Works and Refurbishment, registration with PKK, CIDB & SPAN is compulsory.

The Registration Categories are:

Category Details
a. Major Capital Works Sewage Treatment Plants, Sewerage Network and Pump Stations, Specialist Services.

Sewage Treatment Plants: Construction of New Sewage Treatment Plants, Upgrading of existing sewage treatment plants, Construction of Centralised Sludge treatment facilities, major pump stations.

Sewerage Network and Pump Stations: Construction of trunk sewers, manholes, laterals, intermediate pumps stations, force mains, relocation and diversion of existing sewers.

Refurbishment works category 2&5 and 3&4
  • Refurbishment works category 2&5: Packaged Civil and Structural Works. Fencing, brick walls and gates, manholes, inspection covers, gratings and railings, step irons, ladders, stairs, landings and handrails, doors and windows, access roads and internal vehicular movement, stormwater drains, tree cutting and removal, rubbish and rubble removal, grass cutting, herbicide spraying, painting
  • Refurbishment works category 3&4: Mechanical, Electrical & Desludging works :

Specialist Services: Micro tunneling, pipe jacking.
b. Minor Civil Works Minor civil works under O&M supervision.
c. Mechanical and Electrical Works Refurbishment: power supply, panels, lighting, wiring and earthing lightning protection mechanical: penstocks, screen and grit removal, flow recorders clarifiers and scrapers, piping and valves, pumps and controls, process equipment, media

Operations M&E : repair to pumps and minor equipment, electrical control panel.
d. Operations Maintenance Works Grass cutting, IST Desludging, Cleaning Services, Security services, Electrical Inspection services, sump cleaning, network maintenance, rubbish disposal, plumbing works and CCTV.
e. STP Maintenance Operation & Maintenance of the Sewage Treatment Plants as per specified Scope of Works.

Requirement for Kementerian Kewangan (KK) / Ministry of Finance (MoF) registration is enforced. Currently the compliance to this requirement is gradual.

2.0 REGISTRATION REQUIREMENTS
2.1 Status With The Registrar of Businesses or Registrar of Companies
    Applicants have to be registered with the Registrar of Business or Registrar of Companies before they can be considered for registration with IWK.
2.2 Suruhanjaya Perkhidmatan Air Negara (SPAN)– Contractors
    For construction works, registration with SPAN is compulsory. No contractor is allowed to carry out sewerage related works without SPAN license. The onus is on the contractor to apply for, obtain and maintain its registration with SPAN.

Applicants must submit proof of SPAN License. A copy of the License is required to be submitted with the Application.
2.3 PKK and Construction Industry Development Board (CIDB) Registration - Contractors
    For works under Refurbishment and Capital Works, registration with PKK (Pusat Khidmat Kontraktor ) is compulsory. Tender invitation will be extended to PKK registered contractors under the specified Heads and Sub-heads. A copy of valid PKK Registration Certificate is required to be submitted with the application.

The other requisite requirement is registration with the CIDB. No contractor is allowed to carry out construction work in Malaysia without CIDB registration. The onus is on the contractor to apply for, obtain and maintain its registration with CIDB.

Applicants must submit proof of CIDB Registration. A copy of the Certificate of Registration is required to be submitted with the application. In the case where subcontractor will be used, both need to submit certificates.
2.4 Major Capital Works – Sewage Treatment Plants Registration Category
    To be registered under the Sewage Treatment Plants Registration Category, the applicant must be registered with CIDB under the Civil Engineering Construction (CE) or Mechanical (M) or Electrical (E) Registration Category and Financial Grade of G4 and above and PKK with Head I or Head III and SPAN Type C (Pembetungan).
2.5 Major Capital Works – Sewerage Network and Pump Station Registration Category
    To be registered under the Sewerage Network and Pump Station Registration Category, the applicant must be registered with CIDB under the Civil Engineering Construction (CE) or Mechanical (M) or Electrical (E) Registration Category and Financial Grade of G2 and above and PKK with Head I or Head III and SPAN Type C (Pembetungan).
2.6 Major Capital Works – Specialist Services (Pipe Jacking) Registration Category
    To be registered under the Specialist Services (Pipe Jacking) Registration Category, the applicant must be registered with CIDB under the Civil Engineering Construction (CE) with Specialisation 05 Registration Category and Financial Grade of G2 and above and PKK with Head I sub-head 6a.
2.7 Minor Civil Works Registration Category
    To be registered under the Minor Civil Works Registration Categories, the applicant must be registered with CIDB under the Civil Engineering Construction (CE) or Building (B) Registration Category and Financial Grade of G1 and above and PKK with Head I or Ministry of Finance (MoF).
2.8 Mechanical and Electrical Works Registration Category
    To be registered under the Mechanical and Electrical Works Registration Category, the applicant must be registered with CIDB under the Mechanical (M) or Electrical (E) Registration Category and Financial Grade G1 and above and PKK with Head III or Head VII or Ministry of Finance (MoF) and SPAN Type-D (Pembetungan)
2.9 Bumiputera Classification
    The onus is on the applicant to show proof of its bumiputera status.

The acceptable proof of confirmed bumiputera status is the certificate issued by Pusat Khidmat Kontraktor (PKK certifying bumiputera status or Wibawa status awarded by Ministry of Finance (MoF). Others claiming but without such proof will be classified as unconfirmed Bumiputera companies.

IWK will evaluate applicants to determine whether they qualify for bumiputera status based on official company documentation.
2.10 Locations of Work
    The applicant will be required to specify the States in which the applicant is interested in carrying out work. Only contractors and suppliers who are registered for the particular State will be invited to tender for projects in that state.

The onus will be on the applicant to ensure that the applicant has the capacity and capability to carry out construction work in the State registered for.
3.0 Related Companies/Business
    The applicant is required to identify any companies and/or business that may be related to the applicant if these companies and/or business are either applying for or are registered with Indah Water Konsortium Sdn. Bhd. For the purposes of this registration, companies and/or business are considered to be related if

  • the company and/or business have one or more common directors and/or shareholders
  • the companies and/or business have a common address
  • any of the companies, businesses, directors and/or shareholders have a controlling interest or can exercise control over the other companies or businesses
4.0 TERMS AND CONDITIONS OF REGISTRATION
    Registration is non-transferable. The Registration is valid during the specified period provided there have been no material changes in the Contractor’s / suppliers ability to meet the registration requirements. Registration shall be valid for a period of 5 years after which a Contractor/ supplier shall apply for renewal of registration within 60 days before the expiry date of registration.

The Contractor/supplier shall be responsible for maintaining the validity of all legally required registrations such as the CIDB, PKK, MoF and SPAN Registration and shall notify IWK of any changes affecting its IWK registration status.

All Contractors shall be required to obtain Licences from SPAN. All contractors carrying out sewerage works must possess this license. Applicants may be registered as Indah Water Contractor without this license. However they will not be allowed to carry out works without a valid license from (SPAN).

Contractor who do not hold valid SPAN license on being offered a contract will be required to obtain the relevant license within 14 days of award of the contract.

A Contractor’s registration is subject to review at any time to ascertain his eligibility to the present grade and category of registration. A Contractor must submit to IWK any information that may be required from time to time.

Removal from Register

IWK reserves the right to deregister any Contractor/Supplier without giving notice or explanation.

At the same time IWK also reserves the right to remove from the IWK Register of Contractor/Suppliers any Contractor/Supplier who commits any of the acts listed below:

  • Any of the following shall be sufficient cause for removal from the IWK Register.
  • the Contractor/Supplier has been adjudicated a bankrupt
  • the Contractor/Supplier has been presented with a winding-up petition
  • the Contractor has been deregistered by PKK or CIDB or SPAN or MoF
  • the Contractor’s PKK or CIDB or SPAN or MoF registration has lapsed
  • the Contractor/Supplier has obtained IWK Registration by making or causing to be made any false or fraudulent declaration, certification or representation either in writing or otherwise
  • the Contractor has abandoned any construction work undertaken
  • the Contractor/Supplier has been found guilty by the Court to be negligent in connection with any works undertaken
  • the Contractor/Supplier has been involved in improper tendering or fraudulent practices such as collusion and bribery
  • the Contractor/Supplier and one or more of the Contractor/Supplier’s related companies have submitted tenders for the same project
  • the Contractor/Supplier did not comply to safety procedures
  • the Contractor/Supplier did not comply to IWK specifications
  • The Contractor/Supplier’s performance will be continuously appraised and in addition to the above causes for removal, Contractor/Suppliers may also be removed from the Register for consistent poor performance and failure to respond positively to warnings from IWK
  • Contractor/Supplier and the Directors and shareholders will also be blacklisted for future projects and future registrations.
